THE COVERAGE PROVIDED IS SUBJECT TO THE REQUIREMENTS AND LIMITATIONS DESCRIBED IN THESE TERMS AND CONDITIONS.

Throughout this agreement "SWW", "us", "we", or "our" refers to State Wide Warranty. "Homeowner", "agreement holder' or "you(r)" refers to the authorized name(s) listed under the policy at the time of enrollment.

A. COVERAGE PERIOD
Coverage will begin after 30 days of approval and receipt of monetary payment unless agreed to otherwise. During the period of time specified in the agreement, State Wide Warranty (SWW) will provide a qualified service contractor to amend or replace a covered item in the event of malfunction or normal everyday wear and tear.

B. COVERAGE
It is the responsibility of the homeowner to service and maintain all systems and appliances as per manufacturer instructions. Failure to comply may void the warranty of that system. Replacement for covered items shall be made:
  • If they become inoperable due to aggregate, longitudinal usage (normal "wear and tear")
  • If they are located within the main structure of the house, building, or piece of property designated by the agreement
  • If they are properly functioning when this agreement had been accepted and known to not have any malfunctions or serious detriment
  • If new items are systematically installed with routine professionalism
During the coverage period, State Wide Warranty will be solely responsible for arranging a qualified service provider to repair or replace, at SWW's expense (not exceeding $10,000 per 365 day coverage period and further subject to the limits stated below, the systems components designated as "INCLUDED"
  • Are located inside the home (excluding garage). Optional coverage for exterior pool/spa, well pump, septic tank, and external air conditioners is available at additional cost (subject to the plan chosen). This does not cover any known or unknown pre-existing conditions.
  • State Wide Warranty is NOT a service provider and is not performing any repairs or replacements itself.
Only occupied single-family residences (houses, apartments, townhomes, cooperatives and condominiums) with less than 5,000 square feet of occupied living space are covered any homes above 5,000 square feet require additional payment.

C. CUSTOMER SERVICE
1. In the event that a covered item has malfunctioned or is within the limits of coverage specifically stated by the agreement, State Wide Warranty must be contacted within 24 hours and receive notification.
2. State Wide Warranty maintains the right to select the service contractor, which may be a company affiliated with State Wide Warranty. SWW is not responsible for and will not reimburse any monies to persons who have sought and received repairs, reinstallations, or services provided by other parties unless an authorization code was provided by SWW. SWW Preferred Technician ProgramTM gives the homeowner the option of choosing a local technician of preference. Note: SWW must be in correspondence with the technician directly prior to dispatching and/or performing any services at the property.
3. When a request for service is made, SWW will contact a reputable contractor within 24 hours. In case of emergency a service contractor will be contacted within 7 to 12 hours. A service fee applies for each trade service call made, or the actual cost depending upon which deductible fee is the lesser amount.

D. COVERAGE (DEPENDANT ON SWW PLAN TYPE CHOSEN)
1. Range/Oven/Cooktop: All necessary components and parts in a gas or electric oven/stove cook top are COVERED, with the exception of oven racks, glass clocks, timers, lights, trays, shelves, glass doors, self-cleaning features, meat probes, rotisseries, baskets, exterior trim, and oven tool accessories, which are NOT COVERED.
2. Built-In Microwave: Everything is COVERED except for glass handles, doors, hinges, racks, lights, and additional microwavable, as well as portable, countertop, and standalone units, all of which are NOT COVERED.
3. Dishwasher: All necessary components and parts are COVERED with the exception of rollers, baskets and racks, doors, cleaning, and associated gadgets, which are NOT COVERED.
4. Refrigerator: One standard kitchen refrigerator, complete with all the necessary components and parts, is COVERED with the exception of doors, hinges, cosmetic work, racks/shelves, drawers, lights, free-standing ice makers, ice-making and/or water dispensing units, digitally operated control panels, leaks of any kind, wine coolers, mini refrigerators or beverage units, Freon-lined restrictions, knobs, gaskets, and freely dispensing hot water systems, which are NOT COVERED. Neither shall State Wide Warranty be held liable for the loss of food, beverage or other stored items due to failure of the unit.
5. Garbage Disposal: The entire piece of equipment, inclusive of all necessary components and parts, is COVERED, whereas problems and/or jams caused by bones and foreign objects other than food are NOT COVERED.
6. Clothes Washer: All necessary components and parts are COVERED with the exception of plastic mini tubs, knobs and dials, soap dispensers, filter screens, doors, noise, and irreparable damage to clothing, all of which are NOT COVERED.
7. Clothes Dryer: All necessary components and parts are COVERED except for doors, venting, lint screens, knobs and dials, noise, and irreparable damage to clothing, which are NOT COVERED.
8. Plumbing System: COVERED items are toilet wax ring seals, toilet tanks, bowls, and related functioning mechanisms; any gas, water waste, drain, or vent lines, shower valves, bathtub valves, and other primary stoppage components; risers, gate valves; built-in bathtub unit accompanied by motor and pump assembly. NOT COVERED are the failure of water distribution due to gas, drain, waste, or freezing vent lines; polybutylene or quest piping; breakages or leaks in water lines caused by rust, corrosion, or calcium deposits; slab leaks, clean outs, drum traps, faucets and fixtures, bathtubs and showers; roman tubs, galvanized drain lines, bidets, basket strainers, sinks; grouting septic tanks; water softeners; hot water dispensing units, pressure regulators, shower enclosures/base pans, sewage ejection ejector pumps, holding/storage tanks, trip lever waste and surplus; saunas or steam rooms, bath jets, hose bibs, and control panels. Moreover, State Wide Warranty is not responsible for damage that exceeds $500.00 per agreement term for access, diagnostics, repair, and/or replacement. State Wide Warranty will not pay monies for the process of moving and replacing any built-in appliances or any obstructions impeding access to walls, ceilings, or floors in order to assess and/or repair the malfunctioning mechanism. The authorized service contractor provided will return the area to a rough finish condition, subject to the $500 limit indicated.
9. Heating System: All necessary components and parts for the proper functioning of the system are COVERED with the exception of those components and parts relating to water source heat pumps (geothermal); radiators, valves, radiant heating, dampers, fuel storage tanks, solar heating systems, portable units, baseboard casings, most kinds of filters, fireplaces and key valves, clocks/timers, annexed zoning systems, heat lamps, flues and vents, humidifiers, backflow preventers, registers, cable heat, chimneys, mismatched systems, calcium deposits, wood stoves, pellet stoves, and maintenance, all of which are NOT COVERED. State Wide Warranty will also not cover items that exceed a five-ton capacity. State Wide Warranty will not replace heating systems due to cracked heat exchanger on units over 10 years old. State Wide Warranty will not endorse payment that exceeds $1,500.00 per covered item per agreement term for access, diagnostics, repair, and/or replacement.
10. Water Heater: All necessary components and parts are COVERED with the exception of pressure-reducing valve, solar water heaters, fuel storage tank and/or energy conservation units, instant hot water dispensers, vents and flues, access-insulation blankets, sediment buildup and calcification, and noise, all of which are NOT COVERED. State Wide Warranty will not be responsible for replacing water heaters over 10 years of age.
11. A/C or Cooling Unit: Thermostats, compressors, condenser fan motors, blower fan motors, evaporators, cooler units, air handlers, ducted electric central air conditioning, and all components and parts necessary for the proper functioning of the system are COVERED. Gas air conditioning systems, condenser casings, additional service valves, filters, line dryers, line sets, water cooled condensing units, condensate pumps, registers and grills, primary/secondary drain pans, window units, leveling equipment, evaporative cooler pads, electronic air cleaners, improperly sized air condition units or mismatched systems, annexation of additional latter components, flues, vents, roof jacks/stands, water towers, humidifiers, non-ducted wall units, refrigerant conversions, costs related to freon, freon recapturement, drain line stoppages, water leaks, chillers and related components, maintenance and noise are NOT COVERED. State Wide Warranty will not cover items that exceed a five-ton capacity. State Wide Warranty is not responsible for covering more than two operating systems unless specifically indicated by initial agreement signing at the time of enrollment.
12. Electrical: All necessary components and parts are COVERED; power failures and power surges, wiring of components, auxiliary or sub panels, wire tracing, re-running of new wire for broken lines, central vacuum systems, doorbells, alarms, intercoms, fixtures, attic exhaust fans, and garage door openers are NOT COVERED. State Wide Warranty is not responsible for damage that exceeds $500.00 per agreement term for access, diagnostics, repair, and/or replacement.
13. Ductwork: Ducts from heating and/or cooling units to the point of attachment at flex ductwork, grills, or registers are COVERED, whereas insulation, asbestos, dampers, improperly sized ductwork, insulated ductwork, registers, and grills are NOT COVERED. State Wide Warranty is not responsible for damage that exceeds $500.00 per agreement term for access, diagnostics, repair, and/or replacement. State Wide Warranty will not pay monies for the process of moving and replacing any built-in appliances or any obstructions impeding access to walls, ceilings, or floors in order to assess and/or repair the malfunctioning mechanism. The authorized service contractor provided will return the area to a rough finish condition, subject to the $500 limit indicated.
14. Plumbing Stoppage: Cleaning of stoppages in drain, vent, and sewer lines within 100 feet from access point is COVERED. Mainline stoppages are cleared when there is a readily accessible ground level cleanout. Stoppages caused by collapsed, broken, or ill damaged vent, drain, and sewer lines outside the limit of 100 feet from given access point or preceding the confines of the main foundation; stoppages due to roots or acquired foreign objects; lines broken or infiltrated by such; costs to provide for a required ground level cleanout; and septic tanks are NOT COVERED.
15. Garage Door Opener: Motor, switches, wiring, track assembly, and receiver units are COVERED. Springs, tracks, travelers, remote transmitters, hinges, doors, sensors, and cables are NOT COVERED.
16. Ceiling Fans: All necessary operating components and parts are COVERED except for fan blades and lights, which are NOT COVERED.

E. OPTIONAL COVERAGE (WITH ADDITIONAL PAYMENT TO THE PLAN CHOSEN)
Extended Coverage is optional and may be purchased up to 30 days after the commencement of the original agreement. Such optional features only cover the exact items that are listed in the plan enrolled in for the allotted time specified in the agreement.
1. Pool and/or Spa Equipment: Both pool and built-in spa equipment (exterior hot tub and whirlpool) are COVERED if they utilize common equipment. If they do not utilize common equipment, then only one or the other is covered unless an additional fee is paid. Coverage applies to above ground, accessible working components and parts of the heating, pumping and filtration system as follows: heater, pump, motor, filter, filter timer, gaskets, blower, timer, valves, limited to back flush, actuator, check, and 2 and 3-way valves, relays and switches, pool sweep motor and pump, above ground plumbing pipes and wiring, except for portable or above ground pools/spas, control panels and electronic boards, lights, liners, maintenance, structural defects, solar equipment, jets, ornamental fountains, waterfalls and their pumping systems, pool cover and related equipment, fill line and fill valve, built-in or detachable cleaning equipment such as, but not limited to, pool sweeps, pop up heads, turbo valves, skimmers, chlorinators, and ionizers , fuel storage tanks, disposable filtration mediums, cracked or corroded casings, grids, cartridges, heat pump, salt water systems are NOT COVERED. SWW will pay no more than $500 per agreement term for access, diagnosis, repair and/or replacement for all covered equipment.
2. Septic Tank Pumping: Main line stoppages/clogs (one time only, and must have existing access or clean out). If a stoppage is due to a septic tank back up, then we will pump the septic tank one time during the term of the plan. Coverage can only become effective if a septic certification was completed within 90 days prior to close of sale. We reserve the right to request a copy of the certification prior to service dispatch.
The cost of gaining or finding access to the septic tank and the cost of sewer hook ups, disposal of waste, chemical treatments, tanks, leach lines, cess pools and mechanical pumps/systems are NOT COVERED. Limited to a total of $200 maximum per agreement term for access, diagnosis, repair and/or replacement for all covered items.
3. Well Pump: All components and parts of well pump utilized for main dwelling are COVERED, except for holding or storage tanks, digging, locating pump, pump retrieval, redrilling of wells, well casings, pressure tanks, pressure switches and gauges, check valve, relief valve, drop pipe, piping or electrical lines leading to or connecting pressure tank and main dwelling including wiring from control box to the pump, booster pumps, well pump and well pump components for geothermal and/or water source heat pumps are NOT COVERED. SWW will pay no more than $500 per agreement term for access, diagnosis and repair and/or replacement for all covered items.
4. Sump Pump: Permanently installed sump pump for ground water, within the foundation of the home or attached garage are COVERED, except for sewerage ejector pumps, portable pumps, backflow preventers, check valves, piping modifications for new installs are NOT COVERED.
5. Central Vacuum: All mechanical system components and parts are COVERED except for ductwork, hoses, blockages, accessories are NOT COVERED.
6. Roof Leak: Repair of shake, shingle, and composition roof leaks over the occupied living area are COVERED, except for porches, patios, cracked and/or missing material, foam roofs, tar and gravel or metal roof, cemwood shakes, masonite shingles, flat or built-up roof, structural leaks adjacent to or caused by appendages of any kind, downspouts flashing, gutters, skylights, decks, patio covers, solar equipment, roof jacks, antennae, satellite components, chimneys, partial roof replacement and preventative maintenance are NOT COVERED. NOTE: If roof must be partially or completely replaced to effect repair, this coverage does not apply. SWW will pay no more than $1,500 per agreement term for access, diagnosis, repair and/or replacement for all covered items.
7. Stand Alone Freezer: All parts and components that affect the operation of the unit are COVERED, except for ice-makers, crushers, dispensers and related equipment, internal shell, racks, shelves, glass displays, lights, knobs and caps, dials, doors, door seals and gaskets, door hinges, door handles, glass, condensation pans, clogged drains and clogged lines, grates, food spoilage, Freon, disposal and recapture of Freon are NOT COVERED.
8. Second Refrigerator: All components and parts, including integral freezer unit are COVERED, except for racks, shelves, lighting and handles, Freon, ice makers, ice crushers, beverage dispensers and their respective equipment, water lines and valve to ice maker, line restrictions, leaks of any kind, interior thermal shells, freezers which are not an integral part of the refrigerator, food spoilage, doors, door seals and gaskets, hinges, glass, audio/visual equipment and internet connection components are NOT COVERED.
9. Septic System: Sewage ejector pump, jet pump, aerobic pump, septic tank and line from house are COVERED, except for leach lines, field lines, lateral lines, tile fields and leach beds, insufficient capacity, clean out, pumping are NOT COVERED. SWW will pay no more than $500 per agreement term for access, diagnosis and repair and/or replacement for all covered items.

F. CANCELLATION
1. The agreement holder may render the agreement null and void within its first 3 days of enrollment for a full refund. If the agreement holder fails to request a cancellation within the valid dates then cancellation is subject to the discretion of State Wide Warranty. Refunds issued after 3 days will be made on a prorated basis.
2. Cancellation requests must be formally written and received by State Wide Warranty. If the request is made over e-mail, the homeowner is required to obtain a confirmation reply.
3. If a claim has been approved by State Wide Warranty, the policy may not be cancelled within the same agreement term. However, the homeowner may receive a prorated refund for the remaining years on a multiple-year term.
4. The agreement may not be cancelled solely because a claim had been denied as per the terms of said agreement. Should the homeowner wish to cancel based on the fact a claim has been legitimately denied, a prorated refund may be issued but will be subjected to a penalty equal twenty-five percent of the paid premium.
5. This agreement cannot be voided by State Wide Warranty unless:
  • There is a failure to pay agreement fees
  • Both the agreement holder and State Wide Warranty deem it mutually beneficial to terminate the agreement
  • The agreement holder has misrepresented him or herself in the issuance of the agreement
6. An appeal of any kind is acceptable and encouraged if the homeowner feels there has been wrongdoing on the part State Wide Warranty. Any appeal must be formally submitted in writing and sent to the corporate address listed on the policy.
7. Cancellation of the agreement results in State Wide Warranty having no responsibility or further affiliation with any parties previously involved.

G. RENEWALS, CHANGES OF INFORMATION
1. If the covered property changes ownership during the course of a valid agreement, State Wide Warranty must be contacted immediately at 877-239-6218 to extend coverage to the new owner so long as there is no misrepresentation in the contract disclosure agreement.
2. Agreement holder may transfer this agreement at any given time during the period by which the dates are valid according to the agreement term.
3. Payment will be seen as tangible evidence of informed consent to the terms and conditions of the agreement.
4. All SWW annually prepaid plans will be guaranteed the same rate for renewal.

H. INVESTMENT PROPERTY, MULTIPLE UNITS
1. If State Wide Warranty is chosen to cover a duplex, triplex, or quadruplex dwelling, then every subsequent unit within such a residence must also be protected with valid agreements agreed upon by State Wide Warranty. If an agreement holder fails to meet this condition, State Wide Warranty shall not be responsible for shared systems within the residence.
2. In the event that the dwelling unit exceeds the characteristics of a quadruplex, then each individual agreement holder is covered for what is specifically determined in each sole agreement, and common systems and appliances will otherwise be excluded.

I. BILLING PROCEDURES
State Wide Warranty accepts payments via credit card, check or money order. Payments should be sent to

Payment is for service, repair, partial or full replacement for manufactured products that State Wide Warranty covers according to the specific agreement in which the homeowner has enrolled. State Wide Warranty is not an insurance company and does not provide warranty, extended warranty, implied warranty, or residential service.

J. ZONING CODE REQUIREMENTS/VIOLATIONS
1. State Wide Warranty is not responsible for any modifications to install an upgrade, nor the costs required to comply with federal, state, or local laws, regulations, or ordinances, or the need to meet current building or zoning code requirements, or for the correction of certain code violations.
2. State Wide Warranty is not responsible for the failure of a federal, state, or local department issuance of a permit or for any monetary penalties involved.
3. State Wide Warranty will not request contractors to perform services, nor pay costs, involving hazardous, toxic materials including but not limited to asbestos, mold, lead paint, sanitation of sewage spills and various other teratogenic agents.
4. State Wide Warranty will also not pay costs to related recapturement/disposal of refrigerants, contaminants, hazardous, or toxic agents and materials, except in the event that costs related to freon recapture are part of your coverage plan.

K. LIABILITY
1. State Wide Warranty is not responsible for providing or closing the accessed point of origin or area to covered items, nor the cost of an additional service fee encountered by the service contractor to dispose or discard an old appliance, system, or damaged component including but not limited to condensing units, capacitors, freezers, refrigerators, evaporator coils, water heaters, compressors, and any potential dangerous or threatening waste materials.
2. State Wide Warranty is not responsible for the repair, restoration, or replacement of commodities due to cosmetic defects incurred during the performance of services. State Wide Warranty will also not be held liable for such consequential or secondary damages as occur pursuant to the performance of services, or the result of delays in obtaining required equipment and related parts as well as labor difficulties.
3. State Wide Warranty has the right to determine whether a covered appliance or system will be replaced or repaired. State Wide Warranty does not cover electronic, computerized, or energy sufficient management systems, devices, and/or appliances.
4. State Wide Warranty, in maintaining a level of efficiency when replacing an appliance or system, will attempt to take into account such factors as dimensions, brand, and color but cannot guarantee a custom fit.
5. State Wide Warranty will not be held responsible for the repair of covered items that need to be covered due to but not limited to the following: chemical and sedimentary build-up, rust, corrosion, abuse, failure to maintain, failure to clean, freezing, fire, storms, accidents, pet damage, water damage, electrical surge, lightening, mud, earthquakes, plate tectonics, water pressure, atmospheric pressure, or an unsettling home.
6. State Wide Warranty is not responsible if a private contractor is used and does not repair, replace, and/or choose a compatible product that is suitable with the malfunctioning system.
7. State Wide Warranty is not responsible for the cost of updating, modifying, or constructing new systems in order to comply with federal, state, or local laws and/or building and zoning codes, nor is SWW responsible for the cost of fixing a violation.
8. State Wide Warranty does not provide routine maintenance, for which it is the homeowner's personal responsibility to care for his or her home and the items listed in the agreement in order for them to receive coverage. State Wide Warranty has the right to receive receipts of maintenance from the agreement holder upon request.
9. State Wide Warranty has the right of discretion concerning items deemed suitable for coverage depending on how the agreement holder has abided by the rules and regulations of the agreement.
10. State Wide Warranty is not responsible for reparations that exceed $1,500.00 for any single unit, operating system, or related appliance for the duration of the policy.
11. State Wide Warranty is not responsible for covering the cost of diagnosis, repair, or replacement of an item that has been corroded, rotten, fungus-ridden, or biologically harmful, thus causing the item in question to malfunction.
12. State Wide Warranty is not responsible for the replacement or repair of an item that has been termed "commercial." State Wide Warranty is furthermore not responsible for the repair or replacement of an item that has been recalled by the manufacturer, regardless of the reason. State Wide Warranty is also not responsible for the repair or replacement of a commodity that has been determined to be "defective" by the Consumer Product Safety Commission or by its manufacturer, such as through warnings issued specifically regarding that product.
13. State Wide Warranty has the right to provide cash in lieu of repair or replacement in the amount of State Wide Warranty's actual cost (which may be determined as a lesser amount than at retail). If parts are no longer available, State Wide Warranty also has the right to offer a cash buyout in the amount of the assessed average costs between labor, parts, and covered repairs.
14. You agree that, in no event, will State Wide Warranty's liability exceed $1,500.00 per item for access, diagnosis and repair and/or replacement. Furthermore you agree that during the first 30 days of the coverage period, State Wide Warranty is not liable for repair and/or replacement of entire systems or appliances.

L. REPLACEMENT, MAINTENANCE REQUIREMENTS
1. Maintenance records are required in the event one of the major systems, such as an air conditioner or water heater, is beyond normal repair and requires replacement of parts or a complete replacement. In the case of a new home purchase where no maintenance records exist, a copy of the home inspection report must be furnished to State Wide Warranty.
2. State Wide Warranty is not a maintenance company. It is the responsibility of the homeowner to properly service and maintain the covered appliances and systems. Failure to comply with proper maintenance protocol as per the manufacturer's specifications will be considered neglect and State Wide Warranty's responsibility for that system or appliance may become void.

M. SUBMISSION TO ARBITRATION
All controversies arising out of this agreement must be submitted to the American Arbitration Association in the State of Delaware under its commercial mediation rules. If they are unable to do so, they agree to submit all disputes that are not resolved to arbitration before the American Arbitration Association in accordance with its Commercial Arbitration Rules. If the parties agree, the mediator involved in the parties' mediation can serve as the arbitrator. Any award of the arbitrator against State Wide Warranty cannot exceed $1,500.00 per claim in the aggregate. You expressly waive all claims in excess of, and agree that its recovery shall not exceed, these amounts. Any such award shall be in satisfaction of all claims by you against State Wide Warranty regardless of the agreement holder's residency. All claims will be resolved and/or settled at that location regardless of whether they are considered valid under local, state, or federal law or subject to limitations of liability. Please note that State Wide Warranty is NOT an insurance company or a service provider.

N. SEVERABILITY
If any provision of this agreement is found to be contrary to law by a court of competent jurisdiction, such provision shall be of no force or effect: but the remainder of this agreement shall continue in full force and effect.
